UnfoldVR Terms Of Service

Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CGArtefacts SRL, VAT ID RO36226786, ("Company," "we," "us," or "our"), regarding your access and use of the UnfoldVR application ("App").
THESE TERMS CONTAIN VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ THEM CAREFULLY.

1. Eligibility

By using any of our Services, you agree to be bound by these Terms and consent to our privacy practices as described in our Privacy Policy (the “Privacy Policy”) that is incorporated by reference into these Terms. If you do not agree to be bound by these Terms or do not consent to our privacy practices as described in the Privacy Policy, do not use any of our Services. To accept these Terms, you must be at least 18 years of age and have reached the legal age of majority in the country in which your Account (defined below) is registered.If you are younger than 18 years of age, or have not yet reached the legal age of majority in the country in which your Account is registered, your parent or legal guardian must create an Account for you and agree to these Terms in order for you to use our Services. Before you begin to use any of our Services, ask your parent or legal guardian to explain these Terms to you.
If you are accepting these Terms on behalf of your child under the age of 18, or age of majority in the country in which your child’s Account is registered, you also (a) represent that you are the parent or legal guardian of your child; (b) affirm that you accept these Terms and consent to the Privacy Policy on behalf of your child; and (c) accept all liability for your child’s actions and compliance with these Terms.

2. Privacy Policy

All personal information we collect through our Services is subject to our Privacy Policy. Please let us know if you have any questions about our practices concerning the collection and processing of your personal information.
We only store 3D drawing data on our servers which we serve in the "Explore Feed" of the VR app. You can freely delete any public drawings you created. This will permanently remove that data from our servers.

3. Account Requirements

To use UnfoldVR you need to own a valid Meta account.
We get access to your User ID, which is a random number that enables us to identify you as a unique user. We also get access to your User Profile which grants us access to your username and profile photo. We only query for the username which we try to display in the app when you launch it.

4. Children

In accordance with the policies of Meta®, our app is available on Quest 2 and Quest 3 for users over 13 years old.
If you become aware of an underage user or a user who has accessed our Games without using a Parent-Managed Account as required by Meta, please contact us by email at support@cgartefacts.com, so we may remove their Account and relevant personal information.

5. Intellectual Property Rights

All aspects of our Services, including, without limitation, any works of authorship (e.g., any trailers, images, sounds, etc.), trademarks, features, or functionality, and other intellectual property contained in, comprising, or underlying our Services, are owned by CGArtefacts SRL and are protected by  international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not use any of the Company's content without express written permission.

6. Limited License to Use our Services

These Terms permit you to use our Services and view and use the content contained in our Services for your personal, non-commercial use only. As to our App, the license contemplated by this Section gives you a personal, non-exclusive, non-transferable, revocable, non-sublicensable, limited license to use one copy of the App for your personal, non-commercial use for gameplay. For clarity, the foregoing license is only granted to those people that have purchased from or otherwise been given access to our Games by us or one of our third party publishers. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material included in our Services. You must not access or use for any commercial purposes any part of our Services or materials available through them. No right, title, or interest in or to our Services or any content thereof is transferred to you, and all rights not expressly granted are reserved by CGArtefacts. Any use of our Services not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

7. Restrictions on User Generated Content

The App is designed to foster creativity and artistic expression. However, to ensure a safe and welcoming environment for all users, the following types of content are strictly prohibited:
- Hateful or Discriminatory: Content that promotes hatred, violence or any kind of discrimination or any other protected characteristic
- Sexually Explicit: Content that is sexually suggestive, exploits, abuses or endangers children
- Violent or Graphic: Content that depicts graphic violence, gore or real-world harm
- Illegal Activities: Content promoting or encouraging illegal activity or behavior
- Harassment or Bullying: Content that targets individuals with the intent to harass, bully, threaten or intimidate
- Intellectual Property Infringement: Content that violates the copyright, trademark or other intellectual property rights of others
- Defamatory or False Statements: Content that makes false statements about a person or entity that are likely to cause damages

8. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, officers and employees from any claims, damages or costs arising from your use of the App or violation of these Terms.

9. Termination

The Company reserves the right to suspend or terminate your access to the App for any violation of these Terms.

10. Changes to Terms and Conditions

The Company may update these Terms at any time.  We will notify you of significant changes via the App or email. Your continued use of the App signifies your acceptance of the updated Terms.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
THE COMPANY DOES NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY USER CONTENT, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Governing Law

These Terms shall be goverened by and construed in accordance with the laws of Romania
